Under Article 87 of the Industrial Property Act, companies and individuals may use trademarks in the course of business or when providing services. In this sense, the actrecognises the rights derived from the use of a distinctive sign, regardless of whether it is registered. However, the right to exclusive use of a trademark is obtained by registration of that mark with the Mexican Institute ofIntellectual Property (IMPI).
