The General Court has affirmed a likelihood of confusion and rejected an appeal against opposition to the trademark OUT DOOR, in which the appellant argued that ‘outdoor’ was a common English word that would be understood by the majority of consumers in the European Union, and that the Appeal Board had not applied the provisions of Article 8(1) of Regulation 207/2009 correctly.
