China’s first-to-file system and registration-based protection regime have long been criticised by the international trademark community. However, the real problem is the number of trademarks: too many are applied for and eventually registered. Many are filed without the intention of use, but rather as a kind of commodity – cheap to obtain and carrying the potential of large profits when subsequently sold. In 2019, 7.83 million trademark applications were filed. In the first half of 2020, despite the impact of COVID-19, the number of trademark filings still reached 4.28 million, which not only clutters the register but also brings big challenges for brand owners. Yongjian Lei, Partner, Wanhuida Intellectual Property
Yongjian Lei is a partner at Wanhuida Intellectual Property and an attorney at law admitted to practice in China. Mr Lei has embarked on his career as an IP practitioner since his graduation from the Law School of Peking University in 2008. Mr Lei received his LLM degree from Stanford Law School.
Mr Lei excels in providing comprehensive services to the clients with regard to cases concerning bad-faith preemptive trademark filings, well-known trademark recognition, trademark purchase, licensing, geographic indications, domain names and copyright. His practice covers prosecution, enforcement, and litigation.
In 2017 Mr Lei was elected a member of the Young Practitioners Committee of the International Trademark Association for the 2018–2019 term. He was recognised as an IP leader of China in the International Visitor Leadership Programme by the US Department of State in 2018. In 2019 he was elected member of the Trademark Office Practices Committee for the 2020-2021 term.

Mingming Yang is a partner at Wanhuida Intellectual Property. He is specialised in trademark prosecution and protection in China. Mr Yang advises extensively on trademark issues, in particular in relation to the building and maintenance of trademark portfolios, stopping trademark squatting, recognition of well-known trademark, contesting provisional refusal, copyright registration as well as tailoring overall strategic schemes to safeguard IP rights in China.
