Goodwill and trademarks: crunchy not smooth

In Kraft v Bega, the Full Court of the Federal Court has confirmed that Bega retains the right to use the trade dress for its peanut butter in Australia, which it acquired through purchasing the peanut butter business of Mondelez in 2017.
