Fourth Circuit: no trade dress protection for functional shape and colour scheme

In CTB Inc v Hog Slat Inc, addressing the scope of trade dress protection, the US Court of Appeals for the Fourth Circuit has found that the shape and colour scheme of a product was functional and therefore eligible only for the Patent Law’s protection of utilitarian inventions.
