EU General Court finds two D designs to be similar
In Diesel SpA v EU Intellectual Property Office (EUIPO), the EU General Court annulled a decision of the EUIPO Second Board of Appeal and found two marks comprising the letter D to be similar. This case again demonstrates the EU General Court’s willingness to grant relatively broad rights in relatively weak mark elements.
