Most EU trademarks do not include descriptions. However, the European Court of Justice recently ruled in a case involving a rare exception. The verdict showed that descriptions play only a subordinate role in the assessment of a trademark‘s distinctive character. The decisive factor is the representation of the applied-for mark.
