Draft law on Euro 2012 Football Championship approved

On June 5 2009 the Ukrainian Parliament adopted the Draft Law on Amendments to the Law of Ukraine with regard to the Organization and Implementation of the Final Part of the European Football Championship of 2012.
 
The law contains general provisions on the organization of the championship and regulates the use of intellectual property belonging to the Union of European Football Associations (UEFA) in Ukraine during the championship.

Article 1 of the law defines 'designations' of UEFA as registered or unregistered trademarks, names, emblems, slogans, signatures, symbols, samples, logotypes, images and/or animations that are connected with the championship, including advertising material and music used with the permission of UEFA.
 
Article 9 of the law provides that the use of intellectual property belonging to UEFA without authorization is prohibited. Unauthorized marketing is also prohibited. Moreover, the law does not allow the publication of printed matter bearing the name, trademarks, symbols, designations or other intellectual property of UEFA.   
 
According to the law, the Ukrainian Patent Office should ensure that:
  • intellectual property belonging to UEFA is registered quickly in Ukraine; and
  • applications filed by third parties for the registration of IP rights do not conflict with UEFA's applications.
A specially formed panel of experts will examine any conflicting applications immediately.
