Domain name dispute resolution policies compared
Most domain name dispute resolution policies share common features,
in particular the three-part test of confusing similarity, bad faith and legitimate
interest. Although only a handful of decisions have been issued to date under
Canada's policy, Sheldon Burshtein and Ian Hay of Blake Cassels & Graydon
LLP find that the new-comer holds significant differences from the UDRP and
the policies of Australia, the United Kingdom and the United States.
