A rights holder is not entitled to preventthird parties from using the trade name of anunregistered mark if such use accords withcommercial practice, good-faith trade practicesand the rules of competition. A rights holdermust tolerate the use of an unregistered mark ifthe right to the unregistered mark was acquiredbefore the trademark application was filed anddoes not have merely ‘local reach’.
