Owners of unregistered marks have no rightto file an infringement action: in practice,nobody can institute proceedings to preventor recover damages for the infringement ofan unregistered trademark. However, theowners of unregistered marks are free to bringa passing off action against any party whichpasses off its goods as those of the mark owner,and to seek remedies in respect thereof.
