The European Court of Justice (ECJ) recently ruled in a case concerning Irish company Ornua Cooperative Ltd. Ornua owned several EU marks, including KERRYGOLD, and Spanish company Tindale & Stanton imported and distributed Irish products in Spain under the sign KERRYMAID. The ECJ examined case law regarding whether likelihood of confusion exists if an EU trademark and a national mark peacefully coexist in part of the European Union.
