British American Tobacco’s application for PODS not stubbed out on appeal

In opposition proceedings against British American Tobacco’s application for PODS in Class 34, the appointed person has remitted the matter to the UKIPO insofar as it relates to the issue of whether “e-cigarettes” are a sub-category of “cigarettes”.
