Beverage can design held to be devoid of individual character

In Ball Beverage Packaging Europe, Ltd v EU Intellectual Property Office, the General Court upheld a Third Board of Appeal decision which had declared a beverage can design by Ball to be invalid on the grounds that it was devoid of individual character.
