A dispute involving two banana giants was heard at the District Court of The Hague, when Fyffes accused Chiquita of infringing its HOYA trademark with use of the HOLA mark. The court dismissed the claims on the grounds of genuine use, phonetic and figurative similarity, and conceptual similarity. However, it awarded Chiquita only €6,619 of its €24,507 claim for compensation.
