Applicants allowed to amend applications according to reason for refusal
The Saudi Trademark Office has added a new option allowing trademark applicants to obtain a new decision following the rejection of a trademark application filed through the office's online trademark filing system.
In brief, the new option will allow applicants or their representatives to amend/change their applications according to the reason for rejection issued by the registrar. This amendment/change should be made within 10 days from the date of notification of rejection, and can be made only once.
Once the amendment has been submitted, the registrar will re-examine the application and issue its decision accordingly. If the 10-day deadline has already passed, the 'amend' option will disappear from the online system and the applicant's only available option will be to appeal within the statutory period of 60 days from the date of notification of rejection.
It is anticipated that the new option will give applicants more flexibility and opportunities to overcome a rejection, without the need to file an appeal.
