ALDECOA held to be merely a surname

The Trademark Trial and Appeal Board has affirmed an order denying registration to Eximus Coffee LLC on the principal register for the mark ALDECOA for “coffee, caffeine-free coffee, instant coffee, single serve coffee” based on Section 2(e)(4) of the Trademark Act, due to the mark being considered to be primarily merely a surname. The board allowed the application to register on the supplemental register.
