Our lawyers are recognised advisers on the Internet Corporation for Assigned Names and Numbers (ICANN) and other internet policy matters, including cutting-edge generic top-level domain (gTLD) issues. Clients have sought our counsel in drafting, prosecuting and protecting hundreds of new gTLD applications, along with navigating implementation, operational and ICANN compliance issues as new gTLDs become part of the Internet. We also offer a full range of domain name enforcement services to brand owners navigating the changing internet landscape brought about by ICANN’s new gTLD regime, including serving as a registered trademark clearinghouse agent. Our experience includes drafting the rules and policy for the Hong Kong Internet Registration Corporation Limited and assisting other Asian registries with similar projects. Our Asia practice boasts domain name panellists with the Hong Kong International Arbitration Centre, Asian Domain Name Dispute Resolution Centre, Kuala Lumpur Regional Centre for Arbitration and World Intellectual Property Organisation (WIPO). Additionally, our relationships with government and industry leaders allow us to serve as strong advocates for brand owner and client interests in the development of global internet and domain name policy. In fact, a number of our senior members are active domain dispute panellists with WIPO, a sub-body of the United Nations based in Geneva, responsible for hearing cybersquatting complaints and for ruling on Uniform Domain Name Dispute Resolution Policy actions.

Our team also counsels clients on data protection and privacy matters, including the US Gramm-Leach-Bliley Act, the Health Insurance Portability and Accountability Act, the Children’s Online Privacy Protection Act, the Controlling the Assault of Non-solicited Pornography and Marketing Act (2003), the EU Data Protection and Privacy and the Electronic Communications Directives, as well as identity theft, liability and risk aversion, encryption regulation and security matters. We are knowledgeable in matters regarding the global regulation of export, import and encryption use; the use of cryptography for financial applications; and the issues surrounding security breaches and compliance with federal and state laws and industry standards.
