On November 3 2016, in Abbott Laboratories v Adelphia Supply USA, the US Court of Appeals for the Second Circuit affirmed the District Court for the Eastern District of New York’s grant of a preliminary injunction to cease the sale of international versions of Abbott Laboratories’ diabetes test strips in the United States. The Court of Appeals for the Second Circuit reviewed the decision for abuse of discretion and affirmed the judgment for “substantially the reasons that the district court granted the motion”.
