Success for Vogue owner as application for figurative V.O.G.U.E. mark is refused
In decision No UP/I-381-04/16-010/1320; 559-04/3-18-015/MP of 21 March 2018, the Croatian IP Office has accepted the opposition filed by Advance Magazine Publishers Inc (United states) and refused to grant protection to the trademark V.O.G.U.E. BY MIRJANA SMOLJO (and device) (No Z20161320A) in Class 44, filed in the name of Mirjana Smoljo from Zagreb, Croatia. The refusal was based on the mark’s confusing similarity with the earlier EU trademark VOGUE GIRL (EUTM 003529393), which covered - among other things - services in Class 44.
