Blow for Storck as sweets packaging is held to lack distinctiveness
The Swiss Federal Administrative Court has dismissed an appeal against a decision of the Federal Institute of Intellectual Property (IGE) in which the latter had refused to register a trademark consisting of August Storck KG's blue, white and grey packaging for goods in Class 30 of the Nice Classification (Case B-1722/2016, March 28 2018).
