Crabs v crayfish: decisions highlight appropriate considerations when assessing dominant element
The General Court has issued judgments in two appeals concerning whether marks featuring crayfish designs filed by Roshen, a Ukrainian confectionery manufacturer, were confusingly similar to an earlier mark featuring a crayfish design owned by Moscow Confectionery Factory (MCF), a Russian confectionery manufacturer (Cases T-775/16 and T-795/16).
