On July 20 2017 the European Court of Justice (ECJ) ruled in Ornua Cooperative Ltd (formerly the Irish Dairy Board Co-operative Ltd) v Tindale & Stanton Ltd España SL (TS). Ornua, an Irish company, owned several EU marks in Class 29 including the word mark KERRYGOLD and the following two figurative marks.
