ECJ clarifies test to determine whether use of earlier sign is significant
The dispute in Fiesta Hotels & Resorts SL v European Union Intellectual Property Office (EUIPO) (Case C-75/17 P) hinged on whether an unregistered Spanish trade name could successfully be relied upon to cancel the registration of a similar earlier EU trademark pursuant to Article 8(4) of Regulation 207/2009.
