ECJ hands down long-awaited hyperlinking decision

The European Court of Justice (ECJ) has ruled that posting a hyperlink to copyright-protected works that are published without the author’s consent does not automatically constitute a ‘communication to the public’ – provided that the poster seeks no financial gain and is unaware that the works were published illegally.
