Colm Dobbyn, group executive and associate general counsel at MasterCard Worldwide, has been at the company for more than a decade, following a five-year stint at PepsiCo. This extensive in-house experience makes him perfectly placed to identify the key qualities that today’s corporate trademark counsel need to succeed. “It is important for trademark professionals to develop a sense of proportion when dealing in enforcement and contentious matters,” he suggests. “These days, it is very easy for an accused infringer to post a cease and desist letter online and to portray a trademark owner as a bully. It is therefore important to consider how the content of a demand letter will be perceived.
