The plaintiff (US company Fronto King) supplied the defendants (Five A and New Generation Imports) with tobacco leaf products packed in pouches for distribution to convenience stores and petrol station outlets. The individual packages displayed the federally registered mark FRONTO KING along with a related but subsequently federally registered crown design mark. The word mark FRONTO KING had achieved incontestable status.
