ECJ rules in MERCK case 10 Nov 17
The European Court of Justice (ECJ) was asked to give a preliminary ruling on the interpretation of Article 109 of Council Regulation (EC) 207/2009. The request was made in proceedings between Merck KGaA (the applicant), and Merck & Co Inc, Merck Sharp & Dhome Corp and MSD Sharp & Dohme GmbH (the defendants).
