The recent case of EU Intellectual Property Office (EUIPO) v Cactus SA (C-501/15), October 11 2017 concerned an opposition to a 2009 EU trademark application for the mark CACTUS OF PEACE CACTUS DE LA PAZ, based on a likelihood of confusion with an earlier 2002 EU figurative mark comprising a stylised image of a cactus alongside the word 'cactus' (the opponent’s mark), both shown below.
